  1. CONTRACT

    1. These Terms of use (Terms) govern your use of the website located at www.empoweringyourway.com (Website).
    2. You accept the Terms as they apply from time to time whenever you access the Website, and accessing the Website forms a contract between Empowering Your Way (we, us, our) and persons who access the Website (you).
    3. We may change these Terms from time to time. Any changes will come into effect when the updated terms and conditions are posted to the Website. These terms are important and you should ensure that you read them carefully before using the remainder of the website. You can contact us via email at [email protected].
    4. The information provided on this site and in our courses and seminars is not medical advice, we do not conduct a medical business and we do not recommend any solutions.
    5. Testimonials published by us are independent and genuine. However, they do not represent a guarantee or warranty of similar results.
  2. SITE USE LICENCE

    1. We grant you a non-exclusive, worldwide, non-transferable licence to use the Website in accordance with the terms and conditions set out in this agreement.
    2. You may access the Website using a publicly available web browser commonly used to view websites, and you may print a copy of any page within the site for your personal non-commercial use.
    3. You acknowledge and agree that we may alter or cease the operation of the Website at any time in our sole discretion, and the Website may be unavailable from time to time, including for maintenance purposes.
    4. We may terminate your licence to use the Website without notice if you breach these Terms.
    5. When using the website:
      1. You are solely responsible and liable for all activities on the website.
      2. You shall not submit to appear on the website and social media pages linked to the website any review, comment, link or other material whatsoever that may reasonably be deemed to be offensive, illegal, inappropriate or in any way; promote racism, bigotry, hatred or physical harm of any kind against any group or individual; harass or advocate harassment of another person; promote any conduct that is abusive, threatening, obscene, defamatory or libellous; promote any illegal activities; promote or contain information that you know or believe to be inaccurate, false or misleading; infringe any rights of any third party.
      3. You warrant and represent that you own or are licensed to use any and all the intellectual property rights in any enquire that you make to the website.
    6. You further agree that at all times, you shall:
      1. Not impersonate another person on our website; not use the information presented on the website for any purposes other than those expressly set out in these terms and conditions; not do anything likely to impair, interfere with or damage or cause harm or distress to any persons using the website or to Empowering Your Way; not use the Empowering Your Way website or eLearning platform to promote your own services and products without having a prior written consent from Empowering Your Way.
      2. Any violation of these policies will result in your immediate removal from the Empowering Your Way website/space/account/eLearning platform without any prior notice.
  3. POSTING INFORMATION & COMMENTS

 

  1. You must not:
    1. alter the Website in any way except as permitted by these Terms
    2. upload any data to the Website other than to submit text in a text form provided for that purpose
  2. You must not add any content to the Website:
    1. Unless you hold all necessary rights and consents to do so
    2. That might cause a breach of any law or other obligation
    3. That might be defamatory, offensive, pornographic, in breach of confidence or a similar obligation, threatening, abusive, liable to incite hatred or a breach of privacy
    4. That might be considered as spam or commercial advertising
    5. That infringes any rights belonging to another person.
    6. By posting or adding any content to the Website or posting or making comments during webinars conducted by us, you grant us a perpetual, non-exclusive, royalty free, irrevocable, worldwide and transferable right and licence to use that content in any way without limitation, and you permit us to authorise any other person to do the same thing. You consent to anything which we may do or not do in relation to your content which would otherwise be in breach of your moral rights. This includes that we may use your content without attributing you as the source of our content.
    7. If you email us, unless you specify otherwise, you grant us the same rights in relation to the email as set out in clause 2.6.
    8. You warrant to us that you have the right to grant any rights, licences, consents or waivers required under these Terms.
  3. VIDEO / PHOTO CONSENT AND RELEASE

    1. You consent to be audio and/or video recorded and/or video conference and/or photographed during Empowering Your Way’s events (onsite/online workshops and retreats). Empowering Your Way has the right to reproduce and distribute your contribution as part of the collective work.
    2. You authorise Empowering Your Way to edit, reproduce, publish online, exhibit, broadcast and distribute said recording as a part of its legal education function, in any medium now in existence or which may be developed in the future, including streaming over the Internet; and further authorise the use of your name and likeness for purposes of promoting Empowering Your Way’s events, and the use of any photographs/videos taken during our events for purposes consistent with this agreement.
  4. PRIVACY

    1. You agree that we will collect and manage your personal information supplied to us in accordance with our Privacy Policy.

  5. LINKS TO THIRD PARTY WEBSITES

    1. The Website includes links to other websites that are operated by third parties. We are not responsible for and do not sponsor, endorse or approve the content or operation of those websites or any products, services or information contained in them or offered by them. You should review the privacy policy and terms and conditions of use of those websites when you visit them.
  6. INTELLECTUAL PROPERTY

    1. Unless otherwise indicated, all materials on the Website, including text, graphics, design, names, logos, and underlying software are protected or licensed by us, and you acknowledge and agree that this is the case.
    2. Except as permitted by law, you must not modify, copy, reproduce, frame, upload to a third party, post, transmit or distribute the material except as provided for in these Terms unless authorised in writing.
    3. We permit the material on the Website to be downloaded to your computer for viewing and/or printing, as long as:
      1. the material is kept intact and in the same form as presented on the Website (including any copyright or other notice);
      2. it is for your personal, non-commercial use;
      3. it is used for a lawful purpose; and
      4. the material is appropriately attributed to us or the source.
  7. NO SPAM

    1. Publication of email addresses on the Website does not imply consent to the receipt of unsolicited commercial electronic messages or SPAM.
  8. DISCLAIMERS

    1. We take care in creating the information and material on the Website but make no warranties or representations regarding the accuracy, completeness, quality or fitness for the purpose of any material or content.
    2. We do not guarantee that any data, file or program available for download from or via the Website or from any website linked to our website is free from virus or any other condition which might or could damage or interfere with data, hardware or software with which it might be used, and in accessing the Website, you assume all risk of use of all materials, programs and files on the Website. Prior to using any downloaded file you should carry out an appropriate virus check.
    3. We are not liable to you or any person claiming through you for any loss or damage whatsoever caused resulting from the use of the Website, any website linked to the Website, materials or content including the transmission of any virus.
  9. LIMITATION ON LIABILITY

    1. When you acquire services from us:
      1. under no circumstances (including but not limited to any act or omission on the part of us) will we be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use of or access to, or any inability to use or access, the Website;
      2. we exclude all guarantees, conditions, warranties and terms implied by statute, general law or custom.
  10. VALIDITY

    1. If any of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms which will continue in full force and effect.
  11. HEALTH AND SAFETY

    1. The health and safety standards that apply to the services provided under this contract should meet the local standards applicable to the booked destinations, and Empowering Your Way monitors that local standards have been met. We are following the WHO recommendations in relations to COVID-19 containment.
    2. During our retreats, online/onsite workshops and we practise Healing Breathwork (Conscious Connected Breathwork). In consideration of being permitted to participate in any related events or activities with Empowering Your Way (hereinafter collectively “the Activities”), you should acknowledge, understand, and agree to the following:
      1. Pregnancy: During deep breathing, a breather experiences specific psychological changes in the body, including blood becoming more alkaline. This same blood goes through the fetus then. Pregnant women are not allowed to do the breathwork only because there haven’t been any studies on this impact on the fetus’s health. Moreover, premature contractions can be triggered in later periods of pregnancy.
      2. Asthma: If you’re diagnosed with asthma, especially some types of breathwork could be beneficial, but you must have an inhaler available throughout the whole session. Because asthma is a psychosomatic illness, the psyche may intensify the symptoms as it tries to ameliorate the condition. It’s not a contraindication, just a warning to always have an inhaler available with you.
      3. Severe cardiovascular diseases and/or irregularities, including prior heart attack: Strong emotional release or physical movement can stress the cardio system.
      4. Glaucoma: during a breathing session, a breather may stress and strain internally, which could temporarily increase intraocular pressure that would worsen glaucoma symptoms. Moreover, if the breather experiences blurred vision, this may be an undiagnosed case of glaucoma, and a person needs to examine his eyes before continuing breathwork.
      5. High blood pressure: Strong emotional release during breathwork can exacerbate the issues connected to high blood pressure and raise it even higher.
      6. Detached retina: Breathing faster and deeper reduces intraocular pressure. This increases the risk of permanent vision damage for a person with a detached retina.
      7. Psychosis: Any people that are psychotic or if they were recently discharged from an addiction treatment centre shouldn’t do breathwork, as they are not grounded enough to come back to their everyday experience. They go into their psyche and can’t return on track and anchor in reality. According to Grof (1998), an average of good physical and mental resilience is required when practising breathwork.
      8. Epilepsy: There is a slightly increased chance of having a seizure during breathwork due to faster, deeper breathing.
      9. Bipolar disorder or schizophrenia (prior diagnosed): Breathwork could trigger a manic episode; that’s why those people shouldn’t participate in breathwork sessions.
      10. Hospitalization for any psychiatric condition or emotional crisis in the past 10 years, such as an attempted suicide or nervous breakdown: In this case, written approval by a healthcare professional is needed before practicing breathwork. As a facilitator, you want to ensure that this person is grounded enough to handle any intense emotional or physical releases during the session.
      11. PTSD in severe cases: Many breathers have experienced profound healing experiences regarding PTSD. In severe cases, written approval by a healthcare professional is needed to ensure a person is grounded enough to handle what might come up during the session, including possibly reliving the experience which caused the PTSD to release it out of the system. The greatest danger in severe psychiatric conditions is that breathwork can bring up memories that the person is not ready to face yet and this can cause retraumatization.
      12. Osteoporosis; Recent hospitalisation; Severe bone and joint problems; Recent injury or surgery: In altered states of consciousness during breathwork, a person can start moving uncontrollably and hurt themselves if they are facing the issues stated above.
      13. History of strokes and seizures: The amount of oxygen that enters the body is altered which may result in a seizure. Before attempting any breathwork activities, be sure to talk about how they can affect your condition.
      14. Family history of aneurysms: Blood circulation and the amount of oxygen in the body are both impacted by breathwork. Those who are susceptible to aneurysms may be affected differently from those who are not. Be sure to discuss with your doctor whether or not breathwork is a concern for you.
      15. Hypoglycemia and Diabetes: Caution is needed due to changing oxygen and carbon dioxide levels in the blood.
      16. Severe infections and unwanted complications: A doctor’s approval is needed to avoid any unforeseeable complications.
      17. Prescription blood thinning/anti-clotting medications such as Coumadin: Blood thinners prevent blood clots from forming. Using these medications may be a contraindication because hyperventilation can be caused by blood clots for example a deep vein thrombosis (DVT) or pulmonary embolus.
    3. You agree to comply with the stated and customary guidance and norms of participation in the Activities. If, however, you observe any unusual hazard during your presence or participation, you will immediately remove yourself from participation in the Activities and bring such to the attention of the nearest official forthwith.
    4. You know, understand and acknowledge that Empowering Your Way are NOT physicians, psychologists, therapists, or healthcare professionals, and the Activities being offered are NOT intended to treat or diagnose, and does NOT include treatment for or diagnosis of, any illnesses, disease or disorders, whether physical, mental, psychological or emotional.
    5. You fully understand and acknowledge that if you were not in such good health, you would not be permitted to partake in the Activities. 

TERMS OF SALE

  1. PAYMENT

    1. All goods sold by us are charged in the currency listed on the order form.
    2. We accept Credit/Debit Cards and bank transfer payments. Empowering Your Way does not charge a service fee for processing the payments. Please note that when paying in a currency other than the payment of the program, Customers must take into account the exchange rate and the commission of their bank. Empowering Your Way is not responsible and in control of the applicable bank fees, bank commissions and exchange rate.
    3. If you wish to use a different method of payment or if you have any questions related to payments, please contact us at [email protected] and we will be happy to assist.
    4. To secure a retreat booking you will be required to pay a full price, a deposit, or the first instalment of a monthly payment plan as shown on the program’s page.
    5. For Empowering Your Way’s Coaching Programmes you will be required to pay the initial instalment in full in order to start your programme.
      You may request to make payment by instalments. If you and we agree that you may make payments by instalments, you must pay all instalments on or before each due date.
    6. The due date for each instalment is 30 days after purchase and payment of the first instalment and 30 days after each previous instalment.
      Paid monthly amount is non-refundable if the booking is cancelled.
    7. All workshops are a one-time payment.
    8. Should you wish to give the gift of wellbeing and transformation, we will be happy to share the gift voucher on your behalf and assist throughout the entire booking process. Please contact us at [email protected] for further information.
  2. BOOKING CONFIRMATION

    1. Upon receipt of your payments via the methods stated at Art. 1, you will receive:
    2. An email confirming from Empowering Your Way within 24-48 hours.
    3. An email outlining details of the booked program will follow.
    4. Please check the confirmations carefully to make sure that all your booking details are correct. Contact us at [email protected] if your confirmation appears to be incorrect or incomplete and we will endeavour to make the necessary changes. Empowering Your Way reserves the right to make changes to and correct errors after bookings have been confirmed. Empowering Your Way is unable to accept liability for any errors and omissions that are not highlighted to us prior to reservation or arrival, and the client remains responsible for any additional costs or changes that occur as a result.
    5. The invoices issued by Empowering Your Way will contain the customer’s information as provided to Empowering Your Way at the time of the reservation. Any changes requested after the invoice has been issued by Empowering Your Way might be declined by Empowering Your Way according to the legal requirements that Empowering Your Way must comply with.
  3. CANCELLATIONS & REFUNDS POLICY

    1. All requests for cancellations and refunds must be sent via email to [email protected].
    2. Workshops, packages, and all purchases are non-refundable, non-transferrable and no credit will be offered.
    3. Private classes and group bookings can be rescheduled without penalty with at least 48 hours advance. If less than 48 hours notice is given, the class will not be refundable or transferred
    4. ‘No shows’ in any of Empowering Your Way programs or events are considered cancellations from the Participant’s side. In this case, no refunds will be issued and the Participant doesn’t have the right to keep the payment as credit for future reservations.
    5. The cancellation of a program is final and irrevocable once the refund has been issued by Empowering Your Way. The Student will no longer be entitled to receive additional refunds or have access to the program/s in any way.
    6. The admin fees may apply and are non-refundable.
  4. COUPONS, PROMOTION AND DISCOUNTS

    1. The Empowering Your Way coupons, promotions, and discounts are valid and can be used only under the specified conditions as they were published as a part of the coupon/promotion/discounts campaign.
    2. Empowering Your Way reserves the right to discontinue any coupon / promotion / discount at any time and without prior notice.
    3. Coupons and discount codes apply to in-stock products only.
    4. Only 1 (one) coupon or discount code may be applied per order / reservation / booking.
    5. Coupons and discount codes cannot be combined with other discount offers or applied to prior orders.
    6. A coupon/discount cannot be applied retroactively to bookings/reservations previously placed with Empowering Your Way or after the deadline of the promotion / campaign / discount / coupon has ended.
    7. To redeem the coupon code, the user types the coupon code into the promotional box in the booking field of the Empowering Your Way’s websites and the relevant discount will be automatically deducted from the final price of the qualifying purchase. If the user fails to enter the coupon code at the time of purchase as specified, the purchase will not be eligible for the discount.
    8. Empowering Your Way reserves the right to refuse service provided (including refusal of access to the Customer to the spaces/platforms/chats) to any person who is not following the company’s Terms of Service, who are disrespectful or who are disturbing the use and experience of other customers, including staff and volunteers, and at any time before the program started, during the program or after the program ended, and without prior notice.
  5. AUDIOS / VIDEOS

    1. When you purchase audio or video content from us, we grant you a licence (which is limited, revocable, non-exclusive, non-transferable) to listen to, download or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise copy, reproduce, distribute or use the content other than as set out in this contract. You must not sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom. We may terminate your licence to use any purchased products if you breach this contract.
  6. INFORMATION ACCURACY

    1. Empowering Your Way has taken all care to ensure published information and prices are accurate; however, if we identify an error or omission following publication, we will inform you as soon as possible. The revised information will then form part of your booking. If an error or omission is discovered after your booking is made, we will always try to advise you prior to your visit or start of the program. Whilst very rare, in recognition that human error may arise with regards to the verbal information provided to you, these booking conditions will always take precedence in these instances.
  7. ACTIVITIES AND PROGRAM TIMES

    1. Empowering Your Way reserves the right to alter confirmed times of activities and on occasions, this can occur without prior notice to the customer or Empowering Your Way. If we amend the time of an activity due to inclement weather or other circumstance, we will do our best to reschedule the program or offer a comparable activity, although any such changes would not constitute any entitlement to a refund.
  8. COMPLAINTS

    1. If you have cause for complaint whilst using Empowering Your Way’s services, this must be brought to the attention of Empowering Your Way immediately so that action can be taken to remedy the problem. Failure to report your complaint in this way may jeopardise any claim you subsequently make.
    2. If you have any complaints concerning any services provided by Empowering Your Way you must inform us in writing by email at [email protected] within 28 days of your departure date from Empowering Your Way’s retreat or within 28 days of the conclusion of the Empowering Your Way’s Coaching / Workshop / Retreat. Any complaints received after this period of time will be considered as null / not valid.
